1. Acceptance of Terms
By accessing or using the Rocket Vendors platform (\"Platform\"), you agree to be bound by these Terms of Service (\"Terms\"). These Terms constitute a legally binding agreement between you (\"User,\" \"you,\" or \"your\") and Rocket Vendors (\"Rocket Vendors,\" \"we,\" \"us,\" or \"our\").
If you do not agree to these Terms, you must not access or use the Platform. By creating an account, browsing our Platform, or utilizing any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.
If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and your agreement to these Terms will be treated as the agreement of the organization.
2. Service Description
Rocket Vendors operates as a marketplace and connection platform for real estate service providers. Our Platform facilitates connections between service providers and those seeking real estate-related services.
2.1 Services Offered
Rocket Vendors provides the following services:
- **Vendor Discovery & Matching**: Tools and features to help users discover and match with appropriate real estate service providers based on their specific needs, location, and requirements.
- **Service Provider Vetting**: Evaluation and verification processes for service providers who register on our Platform, including background checks, credential verification, and quality assessments as applicable.
- **Agent & Investor Partner Connections**: Facilitation of professional relationships between real estate agents, investors, and qualified service providers within the real estate industry.
2.2 Platform Functionality
The Platform serves as an intermediary connecting service providers with potential clients. Rocket Vendors does not directly provide real estate services, construction services, inspection services, or other professional services offered by service providers listed on the Platform. We facilitate connections and provide a marketplace infrastructure but are not a party to any agreements made between users and service providers.
2.3 Service Availability
We strive to maintain continuous Platform availability but do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice, for maintenance, updates, or other reasons.
3. User Obligations
3.1 Account Registration
To access certain features of the Platform, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security and confidentiality of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
3.2 Eligibility
You must be at least 18 years of age and have the legal capacity to enter into binding contracts to use the Platform. By using the Platform, you represent and warrant that you meet these requirements.
3.3 Acceptable Use
You agree to use the Platform only for lawful purposes and in accordance with these Terms. You specifically agree NOT to:
- Violate any applicable local, state, national, or international law
- Infringe upon or violate the intellectual property rights of others
- Transmit any material that is defamatory, obscene, offensive, or otherwise objectionable
- Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
- Interfere with or disrupt the Platform or servers or networks connected to the Platform
- Use any automated system, including \"robots,\" \"spiders,\" or \"scrapers\" to access the Platform
- Attempt to gain unauthorized access to any portion of the Platform
- Collect or store personal data about other users without their express consent
- Use the Platform to solicit or compete with service providers for purposes unrelated to legitimate service engagements
- Post or transmit any viruses, malware, or other malicious code
3.4 User Content
Users may submit reviews, ratings, comments, and other content (\"User Content\") to the Platform. You retain ownership of your User Content but grant Rocket Vendors a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Platform and our business operations.
You represent and warrant that:
- You own or have the necessary rights to submit your User Content
- Your User Content does not violate the rights of any third party
- Your User Content complies with these Terms
We reserve the right to remove any User Content that violates these Terms or that we deem inappropriate, at our sole discretion.
4. Appointment Scheduling and Cancellations
4.1 Scheduling Process
The Platform provides tools to facilitate scheduling of consultations, services, or appointments between users and service providers. When you request an appointment through the Platform:
- You are initiating a request subject to service provider acceptance
- Confirmation of an appointment constitutes an agreement between you and the service provider
- Rocket Vendors acts solely as a facilitator and is not a party to the appointment agreement
4.2 Cancellation Policy
Cancellation terms are established by individual service providers. When scheduling an appointment, you will be informed of the applicable cancellation policy. You agree to:
- Review and understand the service provider\'s cancellation policy before confirming an appointment
- Provide timely notice of cancellation according to the service provider\'s policy
- Accept responsibility for any cancellation fees as specified by the service provider\'s policy
4.3 No-Show Policy
If you fail to appear for a scheduled appointment without proper cancellation notice, the service provider may charge a no-show fee. Such fees are determined by the service provider and may be processed through the Platform\'s payment system if payment information is on file.
4.4 Service Provider Cancellations
Service providers may cancel appointments due to emergencies, scheduling conflicts, or other legitimate reasons. While we encourage service providers to provide reasonable notice, Rocket Vendors is not responsible for service provider cancellations or resulting inconvenience.
5. Payment Terms
5.1 Platform Fees
Rocket Vendors may charge fees for use of the Platform, including but not limited to:
- Service provider listing fees
- Transaction fees on services booked through the Platform
- Subscription fees for premium features
- Lead generation fees
All applicable fees will be clearly disclosed before you incur any charges.
5.2 Service Provider Payments
Payments for services rendered by service providers may be processed through the Platform or handled directly between you and the service provider, depending on the service provider\'s preferences and Platform features.
When payments are processed through the Platform:
- You authorize Rocket Vendors and our payment processors to charge your provided payment method
- Prices are as quoted at the time of booking unless otherwise specified
- All payments are in U.S. dollars unless otherwise stated
- You are responsible for any applicable taxes
5.3 Refund Policy
Refunds for services are governed by the individual service provider\'s refund policy. Rocket Vendors does not guarantee refunds for services provided by third-party service providers. Any disputes regarding service quality or refunds should first be addressed directly with the service provider.
Platform fees paid to Rocket Vendors are generally non-refundable except at our sole discretion or as required by law.
5.4 Payment Disputes
If you dispute a charge, you must contact us at contact@example.com within 30 days of the charge. We will investigate legitimate disputes in good faith, but resolution depends on the nature of the dispute and whether it involves Platform fees or service provider fees.
5.5 Payment Information Security
We use third-party payment processors to handle payment transactions. Your payment information is subject to the privacy policies and terms of service of these payment processors. We do not store complete credit card information on our servers.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
6.1 Disclaimer of Liability for Service Provider Actions
ROCKET VENDORS IS A MARKETPLACE PLATFORM THAT CONNECTS USERS WITH INDEPENDENT SERVICE PROVIDERS. WE DO NOT EMPLOY SERVICE PROVIDERS AND ARE NOT RESPONSIBLE FOR THEIR ACTIONS, OMISSIONS, OR THE QUALITY OF SERVICES THEY PROVIDE.
YOU ACKNOWLEDGE AND AGREE THAT:
- Service providers are independent contractors, not employees or agents of Rocket Vendors
- We do not supervise, direct, or control service providers\' work
- We are not responsible for disputes between users and service providers
- We make no guarantees regarding service provider availability, quality, or performance
6.2 General Limitation of Liability
ROCKET VENDORS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, data, or business opportunities
- Property damage or personal injury
- Service interruptions or delays
- Errors or inaccuracies in Platform content
- Unauthorized access to your account or data
THIS LIMITATION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS, EVEN IF ROCKET VENDORS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.
6.3 Maximum Liability Cap
TO THE EXTENT LIABILITY CANNOT BE EXCLUDED BY LAW, ROCKET VENDORS\' TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF:
- The total fees you paid to Rocket Vendors in the twelve (12) months preceding the claim, or
- One hundred dollars ($100.00)
6.4 Basis of the Bargain
YOU ACKNOWLEDGE THAT THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION REFLECT A REASONABLE ALLOCATION OF RISK AND ARE FUNDAMENTAL ELEMENTS OF THE BARGAIN BETWEEN ROCKET VENDORS AND YOU. THE PLATFORM WOULD NOT BE PROVIDED WITHOUT THESE LIMITATIONS.
7. Warranty Disclaimers
7.1 \"AS IS\" and \"AS Available\" Basis
THE PLATFORM AND ALL SERVICES, CONTENT, AND MATERIALS CONTAINED THEREIN ARE PROVIDED ON AN \"AS IS\" AND \"AS AVAILABLE\" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
7.2 Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, ROCKET VENDORS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- **Implied Warranties of Merchantability**: We make no warranty that the Platform is suitable for your particular purposes
- **Implied Warranties of Fitness for a Particular Purpose**: We do not warrant that the Platform will meet your specific requirements
- **Warranties of Title and Non-Infringement**: We do not warrant that your use of the Platform will not infringe third-party rights
- **Warranties Regarding Accuracy**: We do not warrant that information on the Platform is accurate, complete, reliable, or current
- **Warranties of Uninterrupted or Error-Free Service**: We do not guarantee that the Platform will be available, uninterrupted, secure, or error-free
7.3 Service Provider Vetting Disclaimer
While Rocket Vendors conducts vetting processes for service providers, WE MAKE NO REPRESENTATIONS OR WARRANTIES REGARDING:
- The qualifications, licensing, or credentials of service providers
- The quality, safety, or legality of services provided
- The accuracy of information provided by service providers
- The ability of service providers to perform services competently
YOU ARE SOLELY RESPONSIBLE FOR CONDUCTING YOUR OWN DUE DILIGENCE BEFORE ENGAGING ANY SERVICE PROVIDER.
7.4 Third-Party Content Disclaimer
The Platform may contain links to third-party websites or resources. We provide these links for your convenience only and do not endorse, warrant, or assume responsibility for any third-party websites, content, products, or services.
7.5 No Professional Advice
Content on the Platform is for informational purposes only and does not constitute professional advice. You should consult with appropriate professionals before making decisions based on information found on the Platform.
8. Governing Law
8.1 Applicable Law
These Terms and your use of the Platform shall be governed by and construed in accordance with the laws applicable to the jurisdiction where Rocket Vendors operates, without regard to conflict of law principles.
8.2 Dispute Resolution
Any disputes arising out of or relating to these Terms or the Platform shall be resolved through:
